Agreement Overview
These Terms & Conditions (“Agreement”) form a legally binding contract between Surefire Studios (“Company,” “we,” “our,” or “us”) and the Client (“you” or “your”). By using our services, subscribing to a plan, or making a payment, you acknowledge that you have read, understood, and agreed to these terms.
If you do not agree to these terms, you must discontinue using our services immediately.
Services Provided
Surefire Studios provides graphic design and front-end development services, available via:
- Monthly Subscription Plans – Unlimited design & development requests with a defined turnaround time.
- Flat-Rate Hourly Service – Billed per hour for one-time or ongoing design & development tasks.
Scope of Work
We offer:
- ✔ Branding & Identity Design (logos, style guides, business cards, etc.)
- ✔ UI/UX Design (websites, mobile apps, wireframing, prototyping)
- ✔ Web Design & Front-End Development (HTML, CSS, Tailwind, React, WordPress, etc.)
- ✔ Marketing Graphics (social media, email campaigns, ads)
- ✔ Motion Graphics & Animation (GIFs, Lottie animations)
- ✔ Print & Packaging Design
💡 Important: We do not provide back-end development, domain hosting, or deep custom coding beyond front-end work.
Payment & Subscription Terms
Billing
- Payments are processed in advance via Stripe for all services.
- Monthly subscribers are billed automatically on their renewal date.
- Hourly services are billed upon completion based on time tracked at $75/hr.
Subscription Renewal & Cancellation
- Subscriptions automatically renew unless canceled before the next billing cycle.
- Cancellation requests must be made via stripe or submitted via email, Discord, Slack, or Trello.
- Upon cancellation, services continue until the end of the current billing period (no partial refunds).
Revisions & Project Delivery
Unlimited Revisions Policy
- Monthly subscribers are entitled to unlimited revisions as long as the requested revisions do not constitute an entirely new project.
- Flat-rate clients (hourly) are billed for all revisions based on time spent.
Turnaround Times
- Standard Plan: Average 48-hour turnaround per request.
- Pro Plan: Average 24-hour turnaround per request.
- Complex projects may take longer (timelines will be communicated in advance).
Refund Policy
Refunds are not issued under the following conditions:
- ❌ If you have already approved a design or received work.
- ❌ If you have requested revisions.
- ❌ If the cancellation is not related to our services (e.g., business closure, change of mind).
- ❌ If you have not communicated with us for more than 2 weeks.
- ❌ If you have used third-party designers alongside our services.
- ❌ If the project requires a full redesign after completion.
Refund Eligibility
- ✔ If you are a first-time subscriber and dissatisfied within the first 15 days, you may request a partial refund (excluding processing fees and work completed).
- ✔ Refund requests must be submitted via email and will be reviewed on a case-by-case basis.
Intellectual Property & Ownership
- Upon full payment, you own the final design work created specifically for your business.
- Surefire Studios retains ownership of:
- Design frameworks, templates, and pre-existing assets
- Stock graphics or fonts requiring a third-party license (You must purchase licenses for commercial use).
- You may not resell or redistribute our work without prior written consent.
Liability & Disclaimers
Errors & Omissions
- Surefire Studios is not liable for any spelling errors, artwork issues, or data loss once the client has approved and accepted the final work.
- It is the client's responsibility to review and approve all files before publishing.
Service Interruptions
- We are not liable for delays or interruptions due to external factors (e.g., software outages, illness, or unforeseen circumstances).
- If a disruption occurs, we will resume work as soon as possible.
Termination of Services
- We reserve the right to terminate any service or contract if a client violates these terms, engages in abusive behavior, or fails to make payments.
- Any pending work will be delivered up to the point of termination, but no refunds will be issued.
Client Responsibilities
Clients agree to:
- Provide all necessary materials (logos, text, images, etc.) before work begins.
- Use our design request platform (Slack, Trello, or email) for clear communication.
- Approve or request revisions in a timely manner (within 3 business days).
If a client fails to respond for more than 14 days, the project may be considered abandoned and subject to cancellation without refund.
Portfolio & Work Showcase
- We reserve the right to showcase completed work in our portfolio, social media, and marketing materials.
- If you require an NDA (Non-Disclosure Agreement), this must be requested before work begins.
Governing Law & Dispute Resolution
- These Terms & Conditions are governed by the laws of the State of California.
- Any disputes will first be resolved through mediation before legal action is pursued.
